Biographical

Andrew Flake is a seasoned ADR professional, with deep expertise in the resolution of a wide range of complex business disputes in both domestic and cross-border forums. In 2021, after twenty-two years as a litigator and partner at a large and entrepreneurial AmLaw 200 firm, Andrew Flake felt called to found The Flake Law Firm, a best-in-class litigation and dispute resolution boutique.

His focus today is on the arbitration and mediation of complex business dispute, with an emphasis on technology, software and app development, and intellectual property. 

As an arbitrator, Andrew focuses on prompt, efficient, and well-run proceedings that get disputes decided quickly and correctly. He is available to serve as arbitrator in both ad hoc and administered arbitrations, and is a member of the American Arbitration Association’s Commercial, Large Complex Case (LCC), Employment, and Healthcare Panels and as an arbitrator for the International Centre for Dispute Resolution (ICDR) and the World Intellectual Propery Organization (WIPO).

As a mediator, Andrew brings his decades of commercial dispute resolution experience, along with tenacity and creative problem-solving, to help parties and their lawyers resolve their disputes. He approaches every mediation with energy and initiative, with the ability to quickly understand key interests and incentives, to manage interpersonal conflict and emotion, and to employ a range of settlement techniques and modalities, including early dispute resolution (EDR).

His subject matter experience spans a wide-range of commercial matters, including intellectual property, unfair competition, restrictive covenants and theft of trade secrets; healthcare and managed care; employment law, false advertising, trademark and patent infringement as well as defamation and rights of publicity, breach of fiduciary duty, shareholder rights and corporate governance; business divorces; trusts and estates and fiduciary litigation; RICO; breach of commercial contracts, lending and creditors’ rights, product liability, interference with business relations, and business valuation.

He is experienced in both traditional and online dispute resolution.
