Biographical

Born in Pensacola, Florida September 20, 1967. Admitted to the Florida Bar in 1992. Assistant State Attorney in the Second Judicial Circuit 1992 and the First Judicial Circuit 1993-1994. In private practice since 1994. Practices in the areas of personal injury, wrongful death, insurance litigation, insurance defense, products liability, construction law, commercial litigation, and multiple other areas. Have been certified as a Circuit Civil mediator since 2002 and have mediated hundreds of cases in the areas of personal injury, construction law, hurricane cases, medical malpractice and general civil matters.

Rates Information

PROCEDURE / INTAKE FORM / CONFIRMATIONS / NOTICING: Once you initiate a request from the online calendar, you will be prompted to complete an intake form. Please complete this form to the best of your availability. Failure to complete the form can result in delayed confirmation as we need the information requested in order to complete our conflicts check. If you have questions while completing the form, please consult the attorneys or paralegals assigned to the matter. Once the request and intake form is fully submitted, you will receive an automated acknowldgment email from the NADN website stating that the request has been received. This does not mean that the request has been confirmed. Please allow 24-48 hours for the request to be reviewed by my office, upon which time you will receive a separate email directly from my office stating either that the request is confirmed or that we need to proceed with a minor detailed conflicts clearance. If you need to reach this next step as soon as possible, please feel free to contact my assistant at 850-332-6120 ext. 303. Only once a final written confirmation is received directly from my office can the request be considered confirmed for your scheduling and noticing purposes. My office will typically file the notice at or around this point in time. The parties may notice themselves, again, only provided that full confirmation has been received.

TIMES: In order to provide multiple booking options in one day, morning mediation slots must start no later than 9:00 A.M. Central Time and afternoon mediation slots must start no earlier than 1:30 P.M. Central Time. All day slots typically start at 9:00 A.M Central Time but can be modified with permission from Mr. Kirkland.

CANCELLATION / RESCHEDULING: NOTIFICATION OF CANCELLATION OR RESCHEDULING MUST BE RECEIVED BY MY OFFICE AT LEAST FIVE (5) BUSINESS DAYS PRIOR TO THE SCHEDULED MEDIATION DATE IN ORDER TO AVOID BEING CHARGED THE CANCELLATION FEE EQUAL TO THE FULL MINIMUM MEDIATION CHARGE. 

THE ONLY EXCEPTIONS TO THE CANCELLATION/RESCHEDULING POLICY THAT WILL BE CONSIDERED ARE FOR EMERGENCY SITUATIONS, FOR INSTANCE A HEALTH ISSUE FOR ONE OF THE ATTORNEYS OR PARTIES. DISCOVERY MATTERS, RECENTLY DISCLOSED EXPERTS OR NEW INFORMATION DO NOT QUALIFY. 

If a situation arises where there is a cancellation or rescheduling fee incurred, it will be equally split between the parties, unless one party indicates responsibility for the entire fee. If there is a dispute between the partes about who should bear the cost of any cancellation fee, that is a matter between the parties and/or the Court. As a neutral mediator, I will not make any determination as to how any cancellation or rescheduling fee will be split and will expect payment from all parties billed. 

CHARGES: The charge for my services is $250 per hour per party up to a maximum of three parties. For mediations involving more than three parties, I will charge the three-party rate of $750.00 per hour and it will be split equally among the parties. If one half day is reserved, there is a four-hour minimum charge. If a full day is reserved, there is a six-hour minimum charge.

DEPOSITS: A deposit of the minimum charge noted above is required for all mediations and must be received no less than ten (10) days prior to mediation. 

LOCATION: Virtual mediations are offered throughout the state, however, Mr. Kirkland only offers in-person availability in Escambia or Santa Rosa counties unless permission is granted otherwise.
