Biographical

In 2012, after serving sixteen years on the Superior Court, Judge Brian R. Van Camp (Ret.) commenced serving as a mediator, arbitrator, and judicial referee, specializing in broad business, commercial, corporate, real property and employment areas of the law. Lawyers describe Judge Van Camp as well prepared, professional, an empathetic listener and a creative and innovative problem-solver. Attorneys surveyed voted him one of the top Mediators and/or top Arbitrators for Sacramento Magazine’s 2015, 2016, and 2017 annual “Best of…” lists.

Since becoming a full-time neutral, Judge Van Camp has successfully mediated, arbitrated and/or presided over cases with a focus on business and corporate disputes, break-ups and sales, partners’ and shareholders’ actions, real estate sales and leases, employment wrongful termination, professional malpractice, construction defects, software licensing, franchising, insurance coverage, intra- and inter-governmental disputes and class actions.

Judge Van Camp brings over five  decades of judicial and practical legal experience, with an ability to listen carefully to lawyers and their clients, facilitate communication, and where he can, add value based on his bench and practice experience.

EXPERIENCE:

Arbitrator, Mediator and Referee (2012 - Present), complex commercial and business cases involving breaches of contract, including purchase and sales of businesses and property, breaches of fiduciary duty in partnership, LLC and joint venture agreements, securities, franchise and employee class and individual law violations, derivative and other corporate shareholder disputes, real estate sales, partitions and lease disputes, real estate syndications and "waterfall" distributions, agriculture land issues, construction defects, employment, including labor law violations and termination/separation of key officers and their vested stock options, disputes between cannabis dispensers/licensees and landlord, cyber advertisers and brokers, crypto coin ventures, pension/profit-sharing plan ERISA rights, gig economy workers/employees, crop insurance coverage, enforcement of non- compete agreements, software contract performance.

Judge, Superior Court, 1997-2012, presided over civil and complex civil cases involving business breakups, breaches of contracts, leases and sales of property, medical and legalmalpractice suits, wrongful termination/employment, copyright, trademark and trade dress infringement or misappropriation, and personal injury lawsuits. Tried over 250 jury trials and over 40 bench trials.

Business/Corporate & Securities Attorney, 1974-1997, specializing in corporate, securities,franchise, commercial, contract and partnership law, including disputes between partners, directors & shareholders. Also business entity transactions, including formation andfinancing of business organizations, including public and private securities offerings and mergers and acquisitions, and operating issues, including real estate transactions, UCC and Sales issues, key employee contracts and severance, reporting and licensing issues.

California Commissioner of Corporations (1971-1974), oversaw the State Department of Corporations' regulation of public offerings of securities, securities broker-dealers, franchise public offerings and franchisors and a variety of commercial lenders, includingcredit unions, finance companies and industrial loan law companies.

Assistant/Acting Secretary of the State Business & Transportation Agency (1970- 1971), served in Governor Reagan's Cabinet with responsibility for state departments of Banking,Corporations, Insurance, Savings & Loans, Alcohol Bev. Control and Caltrans, Dept. Motor Vehicles, Highway Patrol and Aeronautics.

Agency Attorney, Redevelopment Agency, City of Sacramento (1967-1970), eminentdomain, real estate acquisition and development contracts, municipal finance and public administrative law.

Deputy State Attorney General (1965-1967), Government Law Section, representing various state departments and CA Secretary of State.

Judge Van Camp studied dispute resolution at the Harvard Law School (2010), the Straus Institute at Pepperdine (2012, 2003 and 2001), the NationalJudicial College (2007), Arbitration Rules and Practices by the American Arbitration Association (2014) and twenty other courses sponsored by the AAA. 

Judge Van Camp has taught over 80 CLE courses to judges and lawyers in the areas of corporate, securities, partnership & limited partnerships, non-profit corporations and trial advocacy for his state bar, judicial education center and private seminar providers.

He has published fifteen articles in law reviews and professional journals on corporate law, securities regulation, franchise law, trial advocacy and comparative law (incl. British, South African and International Courts at The Hague).

Rates Information

Hourly Rate: $700

Hearing: $700.00/Hr

Study: $700.00/Hr

Travel: $300.00/Hr

Cancellation: $3600.00/Day

Cancellation Period: 30 Days

Comment: No charge for travel time to metropolitan areas of California.Otherwise, travel time is billed at one-half rate after the first hourof travel by car, or flat $1,000 each way by air.

Mileage: the lesser of $0.50/mile, or coach airfare.

Per diem: $500 in-state, and $600 out-of-state.

Cancellation policy: $3,600/day, if notice given after thirty (30) days before first scheduled Hearing Date.
