Biographical

David H. Lichter is an experienced litigator whose work is now solely devoted to arbitrating a wide variety of disputes and serving as a court-appointed neutral and special master in state and federal court.  Mr. Lichter has arbitrated and mediated more than 2000 matters, is engaged regularly by plaintiffs and defendants and arbitrates cases throughout the United States. He is A/V rated by Martindale-Hubbell® and is included in the 2024 edition of The Best Lawyers in America® (Mediation & Arbitration) (2024 “Lawyer of the Year,” in Arbitration and Mediation; 2022 "Lawyer of the Year", Mediation; 2020 “Lawyer of the Year,” Arbitration), the 2024 edition of Florida Super Lawyers® and was selected as the 2017 “Top Solo” attorney by the Miami-Dade County Bar Association.

Mr. Lichter is a Fellow in the College of Commercial Arbitrators; serves as an approved arbitrator on the Commercial, Large Complex Cases, Employment and Healthcare rosters and as a member of the Master Mediator Panel for the American Arbitration Association; is a neutral with the American Health Lawyers Association; is certified by the Florida Supreme Court as a Certified Civil Circuit Court mediator and by the United States District Courts for the Middle and Southern District of Florida as a Certified Mediator and is listed in the Register of Mediators for the United States Bankruptcy Court for the Southern District of Florida.  He is also certified as a program arbitrator and mediator for the Florida Bar and is a qualified arbitrator under Florida Law. Additionally, Mr. Lichter is a member of the National Academy of Distinguished Neutrals.  He has also acted as an independent investigator and special magistrate in state court. Some of the particular substantive areas in which he has mediated, arbitrated, litigated or served as a special master or special investigator include securities, real estate related matters, contracts, common law breach of fiduciary duty and fraud, employment, health care, insurance coverage, legal and accounting professional liability, public and private financing, buy-sell agreements, trade secrets, trademark and copyright infringement and counterfeiting, covenants not to compete, fraudulent transfers and claw-backs, preference actions, class and collective actions, tortious interference, civil forfeiture, franchises, dealer termination, antitrust, civil rights, Fair Labor Standards Act, False Claims Act, probate, RICO, ADA, FDCPA, FCCPA, FCRA, TCPA, TILA, RESPA, Title VII, corporate derivative actions, and other common law business torts.

Mr. Lichter is a member of the Florida Bar's Standing Committee on Grievance Mediation and Fee Arbitration and a past Vice Chair of the Securities Litigation Committee of the Dade County Bar and past Chair of the Florida Bar’s Federal Court Practice Committee. He has lectured numerous times on mediation or arbitration at the local, state and national level and has published several articles on mediation and arbitration.

David graduated with honors from Brandeis University and received his law degree with honors from Georgetown University Law Center where he participated on the Editorial Board of the American Criminal Law Review. Following graduation, Mr. Lichter served as federal judicial law clerk for two years. After his clerkship, Mr. Lichter worked for nearly five years as an Assistant United States Attorney for the Southern District of Florida where he tried numerous civil and criminal cases and was responsible for many appeals. After leaving the U.S. Attorney’s office, David joined the Miami law firm of Kenny Nachwalter where he became a shareholder and practiced complex business and intellectual property litigation and securities arbitration for 14 years. In 2003, Mr. Lichter established David Lichter & Associates, P.A. which became Higer Lichter & Givner in 2006.  In 2015 he reinstituted his professional association with his wife Mayra as Lichter Law Firm.

Rates Information

  • $575.00 per hour, including review time
  • No minimums
  • Flat rates are available for mediations conducted out of state or outside the Miami-Dade-Broward-Palm Beach County area
