Biographical

David is an experienced litigator whose work is now entirely devoted to mediating and arbitrating a wide variety of disputes and serving as a Special Master in state and federal court.  David is engaged regularly by plaintiffs and defendants and mediates and arbitrates cases throughout the United States as well as Puerto Rico and the Bahamas. He has mediated and arbitrated more than 1,700 matters and has also served as a special master, special investigator and special magistrate in in state and federal court.

David is certified by the Florida Supreme Court as a Certified Civil Circuit and County Court mediator, and by the United States District Courts for the Southern and Middle Districts of Florida as a Certified Mediator and is listed in the Register of Mediators for the United States Bankruptcy Court for the Southern District of Florida. He is also a member of the Commercial, Large Complex, Healthcare and Employment rosters and is a mediator for the American Arbitration Association and is an approved mediator for the Financial Industry Regulatory Authority.  The particular substantive areas in which he has mediated, arbitrated, litigated and served as a special master include securities, real estate, contracts, common law breach of fiduciary duty and fraud, legal and accounting professional liability, trade secrets, trademark and copyright infringement and counterfeiting, covenants not to compete, fraudulent transfers and clawbacks, preference actions, class and collective actions, tortious interference, civil forfeiture, franchises, dealer termination, antitrust, civil rights, False Claims Act, probate, Fair Labor Standards Act, False Claims Act, probate, TCPA, FCRA, FDCPA, RICO, ADA, RESPA, Truth in Lending Act, insurance coverage disputes, health care, corporate derivative disputes, and other common law and statutory business torts.

David graduated with honors from Brandeis University and received his law degree with honors from Georgetown University Law Center. Following graduation, David served as federal judicial law clerk. After his clerkship, David worked for nearly five years as an Assistant United States Attorney for the Southern District of Florida in Miami, Florida, in the appellate, civil, and major crimes and frauds divisions, and tried numerous civil and criminal jury trials. After leaving the U.S. Attorney's office, David practiced with the Kenny Nachwalter law firm for 14 years before establishing David Lichter & Associates, P.A. in 2003, Higer Lichter & Givner in 2006 and the Lichter Law Firm in 2015.

David is a past Vice-Chair of the Securities Litigation Committee of the Dade County Bar Association, and is a past Chair of the Florida Bar's Federal Court Practice Committee. He has lectured numerous times on mediation at the local, state and national level and has published several articles on mediation and arbitration.  David, who is A/V rated by Martindale-Hubbell, is included in the 2019 edition of The Best Lawyers in America in the specialty of Alternative Dispute Resolution, in the 2018 Florida Super Lawyers Magazine in the fields of Alternative Dispute Resolution.

Rates Information

  • $495.00 per hour, including review time

No charge for travel within 25-mile radius of Aventura, Florida offices

  • $250.00 per hour for travel outside 25-mile radius
  • No minimums
  • Flat rates are available for mediations conducted out of state or outside the Miami-Dade-Broward-Palm Beach County area
