Biographical

In 2008 after representing defendants and plaintiffs nearly 50/50 since 1977, I was first retained as a mediator in a medical negligence case. I continued to serve as a mediator on a part time basis through 2019 and transitioned to full time mediator in 2020.

I have mediated hubdreds of cases in Cleveland, Akron, Canton, Toledo, Dayton, Cincinnati, Columbus, Athens, Mansfield, Zanesville, Lancaster, Mt. Vernon, Van Wert, Independence, Beachwood, Rocky River, Mentor, Solon, Mayfield Heights, Dublin and Wheeling, W. Va.

Since March 2000 I have mediated cases (1) virtually; (2) via a hybrid of in person and virtually; and (3) in person (I was vaccinated in March 2021 and received the booster in October 2021).

Lawyers and party decision makers from Ohio, California, Texas, Colorado, Florida, Delaware, New Jersey, Kentucky, Pennsylvania, Alabama, Mississippi, West Virginia, Nebraska, Minnesota, Michigan, Illinois, Arizona, Wisconsin and several other states have approved me as a mediator.

Types of cases I have mediated include medical negligence, product liability, medical device product liability, nursing home neglect, workplace injury, construction accidents, asbestos, transportation, hospitality, commercial litigation, eminent domain, premises liability, serious personal injury (including brain injury and quadriplegia), wrongful death, legal malpractice, employment, intentional tort, insurance coverage, school law, 1983 actions, political subdivision liability, negligent security, CSPA and defamation.

My 40+ years of experience as a defense and plaintiff lawyer including 65+ trials to verdict and more than 1,000 settlements (without a mediator) provide me with a balanced, impartial perspective.

I do not mechanically mediate. Lawyers and party representatives with whom I have mediated know  I am patient, instinctive, creative and persistent after several decades of experience as a trial lawyer. Just as no two cases or trials are the same, every mediation is novel for me. I adapt not only to the facts and issues of each case, but also to the lawyers and party decision-makers unique to each mediation.

My educational background in psychology was valuable for more than four decades as a trial lawyer and has been as a mediator. If I am not much more valuable as a mediator than as a courier of numbers at mediations, parties should hire someone else. My sole objective as a mediator is to do what is needed to try to efficiently facilitate settlements at a mediation. If a case does not resolve on the day of a mediation and I sense that it is in the best interest of the parties to continue with negotiations thereafter, I will remain as a mediator on any matter for as long as it takes to help lawyers and parties effectuate resolution.

Since 2015 I have been asked to speak on mediations frequently to various lawyer professional associations.

Rates Information

John Alton's hourly rate is $350 for all aspects of preparation, the mediation (or arbitration) itself and post mediation (or arbitration) involvement for review of additional written materials, phone conferences, email exchanges, correspondence and/or mediator proposals or written decisions post arbitration hearings.

John Alton's hourly rate is $250 for non-profit entities including agencies of federal, state and local governments for the above services is $250. 

John Alton's hourly rate is $250 for travel to and from mediation venues outside of Central Ohio.

John Alton does not charge for expenses such as parking, hotels, food, etc. for Ohio-venued mediations except John Alton expects reimbursement for his cost advances to reserve conference rooms at Ohio mediation venues, e.g. hotels.

John Alton also expects reimbursement for round trip air travel from Columbus, Ohio to mediate litigated matters in states outside Ohio and associated costs incurred for transportation to and from airports for mediations outside Ohio.
